1 Scope

(1) These terms apply to all orders that consumers place with Alessandro Brozzi (the "seller" or "we") through the Aromahain online shop (https://aromahain.com/en-ie), in the version valid at the time of the order.

(2) A consumer is any natural person who enters into a transaction for purposes that are mainly neither commercial nor related to their independent professional activity.

(3) The offer of this store is addressed to consumers with a delivery address in Ireland.

(4) Different terms of the customer are not accepted unless the seller expressly agrees to them in writing.

2 Contracting party, independence from dōTERRA

(1) The contract of sale is concluded with: Alessandro Brozzi (sole trader), Via della Magliana 188, 00146 Rome, Italy, VAT ID IT18319051001, email info@aromahain.com.

(2) Aromahain is an independent retailer (Independent Wellness Advocate) for products of the dōTERRA brand. dōTERRA® is a registered trademark of dōTERRA Holdings, LLC. This online shop is not operated by dōTERRA. dōTERRA Holdings, LLC and its affiliated companies are not a contracting party of the customer and are not responsible for the services of this shop. This website is not authored or endorsed by dōTERRA or any affiliated company.

3 Conclusion of the contract

(1) The presentation of products in the online shop is not a legally binding offer but a non-binding invitation to the customer to place an order.

(2) The customer can put the desired products in the cart and start the order process with the "Checkout" button. At checkout the customer enters delivery and billing details and chooses the shipping and payment method. Before the order is placed, all order details are shown in an overview. Input errors can be corrected at any time by going back in the browser or with the editing functions of the cart or checkout.

(3) By clicking the button to place the order with an obligation to pay, the customer makes a binding offer to buy the goods in the cart.

(4) After the order is received, the customer immediately receives an automatic email confirming receipt of the order. This confirmation is not yet an acceptance of the offer; it only records that the order has reached us.

(5) The contract is concluded only when we accept the customer's offer. We accept by sending a shipping confirmation by email, at the latest with delivery of the goods. If the seller does not accept the offer within 5 business days after receipt of the order, the offer is deemed rejected, and any payment already made is refunded without undue delay.

(6) For payment methods that are processed directly at checkout, the payment method is charged or the payment instruction is given when the order process is completed; this is not yet an acceptance of the offer by the seller.

4 Returns

(1) As a consumer you have a 14-day return option for sealed products, in addition to your statutory consumer rights. Details, including the period, how to return, the refund and the sample return form, are in our Returns and withdrawal notice.

(2) For hygiene and safety reasons, sealed products cannot be returned if their seal was removed after delivery. This applies in particular to essential oils, oil blends and cosmetic products whose closure, safety seal or film seal has been opened.

(3) The direct cost of returning the goods is paid by the consumer.

(4) To return an order, please write to us at info@aromahain.com with your order number. Please do not send anything back before we have confirmed the return steps and address by email.

(5) Nothing in this section limits your statutory consumer rights.

5 Prices and shipping costs

(1) All prices shown in the online shop are final prices in euros (EUR) and include statutory VAT.

(2) In addition to the prices shown, shipping to Ireland costs €4.90 per order; from an order value of €100 we ship free of charge. The shipping cost is shown to the customer in the cart and at checkout before the order is placed. Any free-shipping promotions are shown separately in the shop.

(3) The prices shown at the time of the order apply.

6 Payment

(1) Payment is made with the payment methods offered at checkout. The payment methods available for a specific order are shown to the customer at checkout before the order is placed. We reserve the right not to offer individual payment methods in a specific case or to refer to other payment methods.

(2) Payments are processed by the payment providers integrated into the Shopify checkout. For some payment methods, additional terms of the respective provider apply, which are shown at checkout.

(3) The purchase price is due when the contract is concluded, unless the chosen payment method provides otherwise.

7 Delivery, delivery area and dispatch

(1) We deliver to addresses in Ireland. Delivery to other countries is not possible through this store.

(2) The goods are shipped in the sealed original dōTERRA packaging, insured and with tracking by a parcel carrier. We dispatch the goods within 2 business days after conclusion of the contract or, for payment methods with advance payment, after receipt of payment. Delivery takes 3–9 business days after payment. Business days are Monday to Friday except public holidays at the place of dispatch.

(3) When the goods are shipped, the customer receives a shipping confirmation by email which, where available, contains a tracking number.

(4) If an ordered product is temporarily unavailable, we inform the customer without undue delay. If the delay is longer than 2 weeks, the customer has the right to withdraw from the contract; payments already made are refunded without undue delay. Further statutory rights of the customer are not affected.

(5) If delivery is not possible because of a circumstance for which the customer is responsible (for example a wrong address or refusal to accept), the customer pays the additional costs this causes, unless the customer has validly returned the order under section 4.

(6) The risk of accidental loss or damage of the goods passes to consumers only when the goods are handed over to the customer.

8 Retention of title

The goods remain the property of the seller until the purchase price has been paid in full.

9 Consumer guarantees

(1) The statutory consumer rights regarding defective goods (legal guarantee of conformity) apply. These terms do not limit them.

(2) Transport damage, notices of defects and complaints should be reported to us at info@aromahain.com as soon as possible, with photos of the parcel and of the damaged contents. Failing to report does not affect the customer's statutory rights.

(3) Statements about products, in particular about the use of essential oils, are not guarantees in the legal sense unless they are expressly called a guarantee.

10 Liability

To the extent permitted by law, our liability is limited as follows. We are fully liable for damage from injury to life, body or health, for damage caused intentionally or by gross negligence, and for fraudulent concealment of a defect. For damage caused by simple negligence we are liable only if an essential contractual duty is breached, and then only for the typical and foreseeable damage. Nothing in these terms excludes, restricts or modifies any right or remedy you have under statutory consumer protection law that cannot be excluded.

11 Product information, intended use, no health claims

(1) The essential oils, oil blends and other products offered in our online shop are cosmetic products, aroma or fragrance products or household products. They are not medicines, not medical devices and not dietary supplements, unless the packaging of the respective product expressly states otherwise.

(2) Our products are not intended to diagnose, treat, cure or prevent any disease. All product descriptions in the shop inform about scent, origin and intended use; they contain no healing or effect promises and do not replace medical advice, diagnosis or treatment. For health complaints, during pregnancy and breastfeeding, for use on children or when taking medication, we recommend asking a doctor or pharmacist before using essential oils.

(3) The customer must follow the directions for use, safety information and warnings on the packaging and product label (in particular: dilute before use on the skin, avoid contact with the eyes, keep out of the reach of children, notes on light sensitivity). Essential oils are highly concentrated and may only be used as intended.

(4) The names and product images of the dōTERRA brand are used only to identify the genuine original products offered.

12 Contract language and storage of the contract

(1) The language available for concluding the contract is English.

(2) We store the contract text. The order data and these terms are sent to the customer by email with the order confirmation. The terms can be viewed, downloaded and printed at any time in their current version on our website. Past orders can be viewed by the customer in their customer account, if they have created one.

13 Dispute resolution

We always try to resolve disagreements directly with the customer. Please write to info@aromahain.com. This does not limit your right to contact a consumer protection agency or to take legal action.

14 Final provisions

(1) If individual provisions of these terms are or become wholly or partly invalid, the validity of the other provisions is not affected.

(2) The seller is not bound by any code of conduct and has not submitted to any code of conduct.
